Porsche AG vs Russian Cayenne club.

«Porsche AG» company, the official Moscow dealer of the German auto concern, has accused «Cayenne club» website of illegal trademark use.

An official representative of «Porsche» in Russia recommended Andrey Gorn to give «Porsche AG» company www.cayenneclub.ru domain under gratuitous use due to a pretrial procedure.

Andrey Gorn, an owner of the website, registered the domain more than two years ago and he takes «Cayenne Club» as his intellectual property.

Andrey Gorn asserts that «Cayenne Club» website is a non commercial organization where any person can become a member; all you need is only registration at the website. A large information database on «Porsche» was created during existence of the club. At the present moment more than three thousand users are registered at the website.

In  Andrey Gorn’s opinion, the «Porsche» writ is just an attempt to take away the well-know website that has a very good auditory, without spending even a cent.

«How it can be explained that I registered the domain name in November 2006 and «Porsche» knew about, but the writ was filed only now? », - Gorn says.

According to his words, having registered the domain he filed a request to «Porsche» to make the club official, but the company refused from collaboration and offered just to give them the website. Gorn also says that accusations as if the website sales spares for «Porsche» don’t have any ground. «If they insist that we really sale something, so then let them try to buy something at our website. The matter is that the website does not sale anything, we only recommend some details to buy for tuning, but we don’t sale anything by ourselves,» - he explained.

«Pravo. RU» сcorrespondents could not get any explanations or comments from «Porsche» representatives in Russia within a few days, though a clear refusal to comment the writ was not got too.

A petition for a protest against closing the club and handing it over to «Porsche AG» company is signed by users collectively.

Worries of other owners of web clubs, that deal with different auto brands, are caused by the situation with «Cayenne Club». Due to their opinion, «Porsche AG» actions are confined by rights of a man for a free distribution and getting information, for a free meetings and establishing organizations under interests, all this is placed in the constitution of the Russian Federation. Even though some lawyers believe that prospects of the writ are not favorable for «Cayenne Club».
